Terms of use.

1. Your agreement

By using this website, placing an order, or buying a gift voucher, you agree to these terms. If you don't agree, please don't use the service. This agreement is governed by the laws of Victoria, Australia.

2. Online orders

An online order is an offer that we accept once your payment has cleared and we send confirmation. We may reject or refund any order if we can't fulfil it (sold out, equipment down, store closing, anything else outside our control). Pickup times are estimates — we'll do our best, but in peak periods times may shift by a few minutes.

Online orders must be picked up on the same day they are placed. Unclaimed orders left for more than 24 hours will be discarded and refunds will be at our discretion.

3. Gift vouchers

Vouchers are issued at fixed amounts ($25, $50, $100), are redeemable in-store at Smiths Beach General Store only, expire three (3) years from the date of purchase, and are non-refundable except as required by Australian Consumer Law (see also our refund policy). They cannot be exchanged for cash. Lost or stolen vouchers may not be replaceable.

4. Food and allergens

We're a small kitchen and we handle nuts, dairy, gluten, soy, eggs, sesame, fish and shellfish. We do our best to honour allergen requests, but we cannot guarantee any item is free from cross-contact. If you have a serious allergy, please tell us at the counter or call ahead on 0459 096 481 — we'll do everything we can but we recommend caution.

5. Alcohol

Where we offer alcoholic drinks, sale is restricted to persons aged 18 or over. Photo ID may be requested at pickup. We can refuse service in line with Victorian liquor licensing law and our responsibilities under it.

6. Liability

Nothing in these terms limits your rights under the Australian Consumer Law. Beyond those non-excludable rights, we are not liable for indirect, incidental or consequential losses arising from your use of the site, the food, or any voucher.

7. Changes to these terms

We may update these terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the site after a change constitutes acceptance of the new terms.
